Starting July 1, 2024, the FMCSA will initiate medical examiner (ME) performance audits using the National Registry's new automated functions. This program includes three audit types: Random Selection Performance Audits to verify proper physical qualification exams, For Cause Performance Audits due to specific complaints, and Eligibility Audits to ensure compliance with certification requirements.<br /><br />Medical examiners may be selected randomly or for specific reasons or to verify eligibility. They are required to submit requested driver examination records—including forms like MCSA-5875 and MCSA-5876—within 48 hours of request, as per regulation 49 CFR 391.43(i). Failure to submit these records on time will result in a notice of proposed removal (NOPR) from the National Registry.<br /><br />Once notified of selection for a performance audit, MEs will find the task in their National Registry account, where they must upload the required records. The task can be delegated to a ME Administrative Assistant (MEAA), but the ME retains full responsibility for compliance.<br /><br />If the 48-hour deadline is missed, the ME will receive a NOPR and must respond within 30 days, either acknowledging the corrective actions required or disputing the NOPR with evidence. Failure to comply will lead to immediate removal from the Registry.<br /><br />In case of removal, MEs can request reinstatement after 30 days, provided they’ve completed the necessary corrective actions and comply with all regulatory requirements. Reinstatement is not guaranteed, as it depends on FMCSA’s review.<br /><br />To assist MEs with these processes, FMCSA provides intuitive new National Registry features, complete with notifications, tasks, and instructions on actions to take if selected for an audit. This includes detailed guidance on the steps needed for compliance, reassignment of tasks, and communication protocols for the audit process.
